Dallas man ejected from van dies in I-10 crash Thursday; driver charged with … – The Times

Louisiana State Police say a driver, traveling eastbound on Interstate 10 near Port Allen, struck a freightliner in the left rear, causing the van to overturn and front seat passenger Roberto-Carlos Rivas to be ejected. Rivas, 26, of Dallas, sustained fatal injuries.

Just before 5:30 p.m. Thursday, Devin Spence of Carriere, MS was driving a 2012 Chevrolet van eastbound on I-10 in the right lane. During the same time, Demetrius Brown, 39, of Houston, driving a 2009 Freightliner tractor-trailer, was also traveling eastbound in the right lane.

Police say Brown was slowing his tractor-trailer due to traffic congestion on I-10. Spence, traveling directly behind the Freightliner, attempted to take what police call “evasive action,” by changing lanes as the tractor-trailer slowed.

When Spence entered the left lane, the front right of his Chevy struck the left rear of the trailer causing the van to overturn.

Rivas, the front seat passenger in Spence’s Chevy, was ejected from the vehicle.

Officials say it’s unknown at this time whether or not Rivas was properly restrained.

However, Spence and Brown were properly restrained and received only minor to moderate injuries. After being released from Our Lady of the Lake Hospital in Baton Rouge, Spence will be booked into the West Baton Rouge Parish jail for negligent homicide.

Drunk driving is not suspected at this time; however, toxicology samples were taken from both drivers and submitted to the Louisiana State Police Crime Lab for analysis.

The crash is still under investigation.
